EYEPTV Terms of Service

Welcome to EYEPTV! These Terms of Service (“Terms”) govern your access to and use of the EYEPTV website (https://eyeptv.net/) and all related services provided by EYEPTV, including but not limited to streaming content, user accounts, and any associated software (“Services”). By accessing or using the EYEPTV Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the EYEPTV Services.

1. Account Terms

To access certain features of the EYEPTV Services, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify EYEPTV immediately of any unauthorized use of your account or any other breach of security.

• You must be at least 18 years of age to create an EYEPTV account.
• You are responsible for all activity occurring under your account.
• You agree to keep your password secure and confidential.
• You may not share your account with any other person.
• EYEPTV reserves the right to suspend or terminate your account if you violate these Terms.

2. Acceptable Use

You agree to use the EYEPTV Services only for lawful purposes and in a manner that does not infringe the rights of others or restrict or inhibit their use and enjoyment of the EYEPTV Services. You agree not to:

• Use the EYEPTV Services to transmit any unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable content.
• Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
• Forge headers or otherwise manipulate identifiers in order to disguise the origin of any content transmitted through the EYEPTV Services.
• Upload, post, email, transmit, or otherwise make available any content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements).
• Upload, post, email, transmit, or otherwise make available any content that infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party.
• Upload, post, email, transmit, or otherwise make available any unsolicited or unauthorized advertising, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other form of solicitation.
• Upload, post, email, transmit, or otherwise make available any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment.
• Interfere with or disrupt the EYEPTV Services or servers or networks connected to the EYEPTV Services, or disobey any requirements, procedures, policies, or regulations of networks connected to the EYEPTV Services.
• Attempt to gain unauthorized access to the EYEPTV Services, other accounts, computer systems, or networks connected to the EYEPTV Services, through hacking, password mining, or any other means.
• Engage in any activity that could damage, disable, overburden, or impair the EYEPTV Services or interfere with any other party’s use and enjoyment of the EYEPTV Services.
• Circumvent, remove, alter, deactivate, degrade, or thwart any of the content protections in the EYEPTV Services.
• Use any robot, spider, scraper, or other automated means to access the EYEPTV Services for any purpose without our express written permission.
• Download, copy, reproduce, distribute, transmit, broadcast, display, sell, license, or otherwise exploit any content from the EYEPTV Services except as expressly authorized by EYEPTV.

3. Payment Terms

Access to certain features of the EYEPTV Services may require payment of a subscription fee. You agree to pay all fees and charges associated with your subscription in accordance with the payment terms in effect at the time of purchase. EYEPTV reserves the right to change its subscription fees and payment terms at any time, with notice to you. Your subscription will automatically renew unless you cancel it before the renewal date. You can cancel your subscription through your account settings on the EYEPTV website. No refunds will be provided for partial subscription periods. All payments are processed securely through our third-party payment processor. EYEPTV is not responsible for any errors or issues arising from the use of the third-party payment processor.

4. Service Availability

EYEPTV will make reasonable efforts to ensure that the EYEPTV Services are available at all times. However, EYEPTV does not guarantee uninterrupted access to the EYEPTV Services. The EYEPTV Services may be unavailable from time to time due to maintenance, technical issues, or other reasons. EYEPTV is not responsible for any loss or damage caused by the unavailability of the EYEPTV Services. EYEPTV may modify, suspend, or discontinue the EYEPTV Services at any time, with or without notice.

5. Liability Limitations

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EYEPTV SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE EYEPTV SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE EYEPTV SERVICES, INCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD PARTIES; (C) ANY CONTENT OBTAINED FROM THE EYEPTV SERVICES; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, EVEN IF EYEPTV HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL EYEPTV’S AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE EYEPTV SERVICES EXCEED THE AMOUNT YOU PAID TO EYEPTV, IF ANY, DURING THE SIX (6) MONTHS PRIOR TO THE ACCRUAL OF THE CLAIM.

EYEPTV is not responsible for the content of any third-party websites or services that may be linked to from the EYEPTV Services. Your use of third-party websites or services is at your own risk.

6. Termination

EYEPTV may terminate your access to the EYEPTV Services at any time, with or without cause, with or without notice. You may terminate your account at any time by contacting support@eyeptv.net. Upon termination, your right to use the EYEPTV Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

EYEPTV reserves the right to investigate suspected violations of these Terms and to take any action we deem appropriate, including, but not limited to, suspending or terminating your account, reporting you to law enforcement authorities, and pursuing legal action.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which EYEPTV is headquartered, without regard to its conflict of law provisions.

8. Changes to These Terms

EYEPTV reserves the right to modify these Terms at any time. We will post any changes to these Terms on the EYEPTV website. Your continued use of the EYEPTV Services after any such changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically for any changes.
