• A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law: This statement must be made under penalty of perjury.
• A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed: This statement must be made under penalty of perjury.
• A physical or electronic signature of the copyright owner or a person authorized to act on their behalf: An electronic signature can be in the form of a typed name and title.

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages. Consider seeking legal counsel before submitting a DMCA notice.

Counter-Notification

If you believe that material you posted on the EYEPTV Website was removed or access to it was disabled as a result of a mistake or misidentification, you may file a counter-notification with EYEPTV’s Designated Agent. To be effective, the counter-notification must be a written communication that includes the following:

• Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled: Please provide the exact URL(s) or a detailed description of where the material was located on the EYEPTV Website before it was removed or disabled.
• A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled: This statement must be made under penalty of perjury.
• Your name, address, and telephone number: Please provide your full legal name, mailing address, and telephone number.
• A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which EYEPTV may be found, and that you will accept service of process from the person who provided notification of the alleged infringement or an agent of such person: This statement is required for EYEPTV to restore the material.
• Your physical or electronic signature: An electronic signature can be in the form of a typed name and title.

Upon receipt of a valid counter-notification, EYEPTV may forward it to the party who submitted the original DMCA notice. The original complaining party will then have ten (10) business days to notify EYEPTV that it has filed an action seeking a court order to restrain the alleged infringing activity. If EYEPTV receives such notification, EYEPTV will not restore the material. If EYEPTV does not receive such notification, EYEPTV may, in its sole discretion, restore the material.

Repeat Infringers

EYEPTV has a policy of terminating the accounts of repeat infringers. A repeat infringer is a user who has been notified of infringing activity more than twice and/or has had infringing material removed from the EYEPTV Website more than twice.

EYEPTV may, in its sole discretion, modify or terminate this DMCA Notice at any time and without prior notice. Any changes to this DMCA Notice will be effective immediately upon posting on the EYEPTV Website.
